Introduction

These General Conditions of Sale applicable to web transactions managed through the site www.thewatchboutique.com (hereinafter referred to as Site), regulate the offer and sale of goods promoted online by The Watch Boutique S.r.l.  (hereinafter referred to as “Seller”), with legal head office in Milan, 2012, Via Brera 7, C.F./PIVA 11394680968, PEC: thewatchboutique@legalmail.it.

These general conditions of sale are drafted in accordance with the legislative provisions of the Civil Code and Legislative Decree no. 206 of September 6, 2005 amended by Legislative Decree no. 21.02.2014 n. 21 (so-called Consumer Code).

In order to proceed with the purchase of one or more products offered on the pages of the Site, the user is asked to register and expressly accept these General Conditions of Sale in order to have access to them even after the conclusion of the contract.

The Conditions of Sale must be accepted expressly for each purchase. The approval of the same is a fundamental prerequisite to be able to finalize the purchase of any product on the page of the Site.

1. Scope of Work

The General Conditions are applied to and discipiline all sales contracts concluded through the site www.thewatchboutique.com, as identified above, hereinafter the “Seller”.

The conditions may be subject to change at any time, so the User is therefore required to consult them before making any purchase.

2. Definitions

Where mentioned in the contract the terms below have the following meanings:

Seller: The Watch Boutique S.r.l., Via Brera 7, 20121 Milan, C.F./P.IVA 11394680968;

Buyer/consumer: the consumer or user, a natural person over the age of eighteen years who signs this contract for the purpose of purchasing the goods from the Seller.

3. Methods of Contract’s Conclusion

Consultation of the products

By consulting the pages of the Website and clicking on the icons corresponding to the articles, the user can easily “navigate” in the virtual catalog of the goods sold by The Watch Boutique S.R.L. In order to view the prices of the products it is necessary to register in the reserved area of the Website.

Registration

To proceed with the purchase of goods, the user must register, or in case of user already registered, enter your username and password. To make the purchase, the user will be required to accept the Conditions of Sale, which will remain available on the pages of the Site. The acceptance of the Terms of Sale shall be made by clicking on the icon “I ACCEPT THE TERMS OF SALE”. At the time of registration, the user must enter their personal data necessary for the purchase, delivery and billing of the same.

Methods of delivery and billing

Once registration is complete, or in the case of users who have already registered, after they have entered their username and password, the user will be asked to provide all the data relating to the invoice holder and the address to which the goods they intend to purchase should be sent.

4. Methods of Payment

The payment must be made within 7 (seven) working days from the date of the order, under penalty of cancellation of the order.

The expected payment is by bank transfer, IBAN ……………………………. made out to The Watch Boutique S.R.L..

In order to speed up the delivery of the goods, please send the account of the transfer by e-mail to info@thewatchboutique.com indicating the order number.

5. Shipping Information

Shipments will be made by courier covered by insurance policy.

The cost of shipping varies depending on the country of destination. The cost will be determined at the time when the user will give all their personal information necessary, including the shipping address, for the purchase of goods and related billing.

In order for the delivery service to be more efficient, it is necessary to receive a telephone number from the user to provide to the courier.

6. Delivery of goods

The products are delivered by couriers, directly to the user, at the shipping address specified by the latter in the order.

Shipping costs may vary depending on the country chosen by the user and will be made known in the order and check out.

7. Right of withdrawal

The Purchaser, as a consumer, has the right to withdraw from the contract of sale, without penalty and without specifying the reason, as established by art. 52 of Legislative Decree 206/2005 (Consumer Code) within the term of 14 (fourteen) calendar days, starting from the day on which the purchaser, or the third party other than the carrier and designated by the Purchaser, acquires physical possession of the goods. To comply with the withdrawal period is sufficient that the consumer sends the communication before the expiry of the withdrawal period.

The right of withdrawal is excluded for the supply of goods made to measure or clearly personalized, pursuant to art. 59 letter c) of the Consumer Code. Are to be understood as falling into this category also the goods of which the consumer requires different sizes from those indicated by The Watch Boutique S.R.L. as available in the presentation of the products.

8. Effects of withdrawal

The consumer who exercises the right of withdrawal has the right to receive a refund of all payments made, possibly including shipping costs, without undue delay and in any case within 14 (fourteen) days from the day on which The Watch Boutique S.R.L. is informed of the consumer’s decision to terminate the contract. The refund will be made by bank transfer to the account that the consumer will indicate on the withdrawal form.

Received the notice of withdrawal, The Watch Boutique S.R.L. will send to the e-mail address provided by the consumer at the time of registration a special code that will identify the goods to their return (“Return Code”). The consumer must return the goods to The Watch Boutique S.R.L. without undue delay and in any case within 14 (fourteen) days from the date on which he communicated his decision to terminate the contract. The deadline is met if the goods are returned before the expiry of the period of 14 days. The direct costs of returning the goods shall be borne by the consumer. All goods must be returned in their original packaging, complete with every accessory, the code tag, the relevant user manuals and any other item received. The consumer must indicate on the packaging of the goods the Return Code assigned.

9. Warranty

The Watch Boutique S.r.l. is responsible to the consumer, pursuant to art. 128 and ss. of the Consumer Code, in relation to any lack of conformity existing at the time of delivery of the goods.

In case of lack of conformity, the consumer has the right to restore, without cost, the conformity of the goods by repair or replacement, or an appropriate reduction in price or termination of the contract, under the conditions provided for in art. 130 of the Consumer Code.

In order to enforce the warranty, the consumer is required to report to the Seller the lack of conformity of the goods within a period of 2 (two) months from the date on which he discovered the defect. The warranty covers non-conformity defects that occur within 2 (two) years from delivery of the goods.

The report of the lack of conformity must be made by sending a registered letter AR to the headquarters of The Watch Boutique S.R.L. or a PEC. Upon receipt of the above-described communication, The Watch Boutique S.R.L. will send to the e-mail address provided by the user at the time of registration a special code that will identify the goods on their return (“Return Code”). The user must prepare the goods for their collection by the employees of The Watch Boutique that, within a period of 7 (seven) working days from the sending of the Return Code, will collect them at the address provided by the consumer. In order to facilitate operations, the consumer must carefully pack the goods including every component and indicate on the package the Return Code. After receiving the goods and checked, The Watch Boutique S.R.L. will restore the conformity within a reasonable period of time, as provided by art. 130 of the Consumer Code.

11. Treatment of personal data

Please note that the personal data processed are those provided to The Watch Boutique S.r.l. by the Buyer for the execution of the contractual relationship. The conferment of all the data inherent to this contract is strictly connected to the execution of the relationship for which, any failure to confer, will lead to the impossibility of the execution of the contractual relationship.

The owner of the processing of personal data, pursuant to EU Regulation 2016/679, is The Watch Boutique S.r.l., Via Brera 7- 20121 Milan-e-mail: info@thewatchboutique.com; which the Buyer may contact at any time to exercise its rights, as interested party, provided for in Articles 15-22 of EU Regulation 2016/679. The complete privacy policy, made pursuant to art. 13 of EU Regulation 2016/679, is provided by The Watch Boutique S.r.l. at the time of signing this contract.

12. Applicable Law and Jurisdiction

Any dispute between Supplier and Purchaser relating to the Contract, and its execution, will be governed by Italian law and administered, unless otherwise provided for, by the judges of the Court of the consumer. The Purchaser will be guaranteed, in any case, the rights conferred by the mandatory consumer protection regulations in force in the country of residence and/or domicile.
